Please read these Terms of Service ("Terms") carefully before downloading, installing, or using Vesper (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Vesper is an iOS application that enables Amazon Vine members to browse items in their Amazon Vine queue. The App displays Amazon's website within the App using the user's Amazon account session. The App does not place orders, submit reviews, or otherwise take action on Amazon on the user's behalf unless the user personally takes that action through the App.
Vesper is an independent third-party application and is not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. or any of its subsidiaries. "Amazon," "Amazon Vine," and related names and logos are trademarks of Amazon.com, Inc. or its affiliates. References to those names are used solely to describe the App's compatibility and intended purpose.
You are solely responsible for your Amazon account, participation in the Amazon Vine program, and compliance with all Amazon terms, policies, and program requirements. The App is a browsing tool only. To the maximum extent permitted by applicable law, Vesper and its operator are not responsible for any consequence affecting your Amazon account or Amazon Vine participation arising from use of the App, including suspension, restriction, or termination of Amazon Vine membership.
The App does not maintain a backend service or remote storage for user data. App functionality and user preferences are processed locally on the user's iPhone or iPad, except that technical crash reports may be processed by Sentry as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
Vesper Pro is an optional auto-renewable subscription available as a monthly or annual plan, each with a 3-day free trial. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device's Settings > [your name] > Subscriptions.
Pro features include shared-queue item alerts delivered through a Cloudflare-hosted API and optional push notifications for new-item burst detection. Push notifications can be enabled or disabled at any time in the App's Settings. Pro does not modify or affect the App's core browsing functionality, which remains free.
The service may be modified, suspended, or discontinued at any time. In the event of discontinuation, active subscribers will not be charged for subsequent renewal periods. No refunds are provided for the current billing period, except as required by applicable law or Apple's refund policies.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, ARE DISCLAIMED. NO REPRESENTATION OR WARRANTY IS MADE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH ANY VERSION OF AMAZON'S WEBSITE. Amazon may modify its website at any time in a manner that affects the App's functionality, and no obligation exists to correct any resulting issue within a particular period or at all.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VESPER AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM OR RELATED TO USE OF, OR INABILITY TO USE, THE APP, INCLUDING LOSS OF AMAZON VINE ELIGIBILITY, ACCOUNT RESTRICTIONS, OR DATA LOSS.
If you downloaded the App from the Apple App Store, your use of the App is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at:

In the event of a conflict between these Terms and the Standard EULA concerning minimum requirements, the Standard EULA shall govern.
Vesper may be updated, modified, suspended, or discontinued, in whole or in part, at any time and without notice. These Terms may also be updated from time to time. Continued use of the App after an updated version of these Terms becomes effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
